Top Tips When Applying For The Australian Protection Visa

Blog

A protection visa is designed for people that seek asylum in Australia. Acquiring the visa can be a daunting task since the immigration department must ascertain that your life is in danger. There are two types of Australian protection visas. Subclass 866 is a permanent protection visa that allows you to live, study and work in Australia indefinitely. On the other hand, subclass 785 is a temporary protection visa that can be renewed every three years. It is ideal for people that plan to go back to their home countries once they establish that the country is safe.

Below are some few tips to improve your chances of getting a protection visa in Australia.

Entering The Country

Under Australian law, people that seek government protection must enter the country legally. As such, your application for a protection visa could be rejected if the immigration department finds out that you entered the country illegally.

Health And Character Requirements

Similar to other visa requests, applicants must meet the Australian government's health and character requirements. You should not be convicted of sexual crimes or affiliated with criminal or terrorist groups. You are also required to present genuine identification documents such as your identity card and birth certificate when applying for this visa.

People with highly infectious diseases such as TB or COVID-19 will have their visa application denied. If you have a chronic illness, the medical officer of the commonwealth will determine whether your condition affects the ability of Australian citizens to access medical care.

Previous Visa Applications

The immigration department will also check your previous visa applications. Typically, people that are citizens in more than one country cannot apply for this visa. The same applies if you have the protection of a third country. People who have had their protection visa cancelled or rejected cannot make subsequent applications. Besides, you can only hold one type of protection visa. As such, people with a safe haven visa or a temporary protection visa cannot apply for the permanent protection visa.

Work With An Immigration Attorney

An immigration attorney will help prove your case with the immigration department. For instance, he or she will organise the required paperwork to show that your life is in danger due to your religion, sexual orientation, culture, religious views or political inclinations. The lawyer will also prepare you for interviews. Besides, he or she can appeal your case if the visa is denied.

You must understand the terms of the protection visa. For instance, it will get revoked if you are convicted of a crime. Besides, you may need a permit from the immigration department if you would want to visit your home country.
